Robert has acted in a wide range of commercial disputes including arbitrations.  He has extensive experience working on heavy and complex cases as part of a team made up of solicitors and other counsel.  He is an experienced trial advocate.

Robert is briefed regularly to give advice (in conference and in writing).  He also takes appointments as a mediator and as an arbitrator.

In recent years, Robert has obtained significant experience in different areas including infrastructure disputes, class actions and professional negligence matters.   For example, he has:

  • acted in two substantial domestic arbitrations arising from the failure of the Basslink electricity cable in December 2015 (for Hydro Tasmania, led by John Rowland QC and with B. Petrie);
  • acted (and continues to act) as lead counsel in two class actions in the Supreme Court of Victoria;
  • acted (and continues to act) in proceedings relating to the use of organochlorine pesticides in Victoria (for the State of Victoria);
  • acted for the Project Company in different proceedings relating to the new Royal Adelaide Hospital, a building project in South Australia;
  • acted for the Linking Melbourne Authority in proceedings relating to the East West Link project, a road project in Victoria;
  • provided advice to governments and statutory bodies;
  • acted in professional negligence disputes;
  • acted as junior counsel in a number of class actions – including the Vioxx class action, the Thalidomide class action and the Timbercorp class action;
  • conducted investigations for a national sporting body; and
  • appeared in disciplinary proceedings.

Robert has appeared in a wide variety of other matters, including AAT proceedings, equity proceedings, contempt proceedings, coronial inquests, asset confiscation proceedings and insolvency proceedings.

Robert is a Fellow of the Chartered Institute of Arbitrators (FCIArb); a Grade 2 Arbitrator at the Resolution Institute; he is a Fellow of the Australian Centre for International Commercial Arbitration (ACICA); and he is a member of Panel of Arbitrators at the Thailand Arbitration Centre. 

Robert is an accredited mediator under the National Mediator Accreditation System. 

Robert is a Code of Conduct Commissioner for Cricket Australia; the Chair of the Football Victoria Appeal Tribunal; and he is the honorary lawyer to the Royal Historical Society of Victoria Inc.

Robert has experience acting in Corporations Act matters in which ASIC has pursued companies or company directors.  For example, he has:

acted for a company director in a substantial insolvent trading claim; acted for the promoters and managers of managed investment schemes; and acted for a listed company the subject of a misleading and deceptive conduct claim.
