O'Callaghan

Anna practises in commercial, public and criminal law. Anna has a particular interest in matters where civil and criminal jurisdictions intersect.  

She has appeared in the Federal Court, the Supreme Court, the County Court, the Magistrates’ Court, the Victorian Civil and Administrative Tribunal (the VCAT) and the Children’s Court.

Commercial Law - Anna has advised and acted for individual and government clients in a variety of commercial matters.

Examples of hearings in which she has appeared include: interlocutory hearings dealing with procedural and evidentiary issues, applications for stay of proceedings, applications to wind up companies, commercial arbitrations in the Magistrates’ Court, judicial mediations in the County Court and Residential Tenancies Act 1997 (Vic) disputes in the VCAT.

Anna has also advised and appeared in commercial matters which have involved criminal law issues.  

Public Law - Anna has experience in both administrative law and constitutional law matters.

Representative matters include:  

  • Meringnage v Interstate Enterprises Pty Ltd & Ors (ongoing matter):  Anna is currently briefed with Christopher Tran and Mark Hosking in a referral of questions of law from the VCAT to the Victorian Supreme Court of Appeal. The questions to be considered include: whether the VCAT is a ‘Court of a State’, whether the VCAT exercises judicial power when determining a claim against the Commonwealth under s.125 of the Equal Opportunity Act 2010 (Vic) and whether such a claim involves a ‘matter’ for the purpose of s.75(iii) of the Constitution.
  • GMQ18 v Minister for Immigration, Citizenship and Multicultural Affairs & Anor (application for urgent injunction): acted for the applicant in an application for an urgent injunction in the Federal Court of Australia, seeking the applicant’s medical transfer from a Regional Processing Centre in Nauru (led by Lisa Di Ferrari SC).

Anna has also accepted briefs to advise and appear in relation to matters concerning claims made under the Equal Opportunity Act 2010 (Vic), applications for a writ of habeas corpus and applications for a writ of mandamus.

Criminal Law - Anna has appeared in the County Court, Magistrates’ Court and Children’s Court in criminal matters for both defence and prosecution. Anna is often briefed by the Office of Public Prosecutions to appear in interlocutory hearings, appeals to the County Court and County Court CCO breach proceedings.

Other experience - Prior to coming to the Bar, Anna was the Senior Associate to His Honour Judge Cosgrave, Head of the Commercial Division at the County Court of Victoria.

Before working at the County Court, Anna was a solicitor at Mills Oakley Lawyers in their Commercial Disputes & Insolvency practice group.

Anna studied at Monash University where she received degrees in Law (first class honours) and Arts (majoring in French Studies).

Anna read with Zoe Maud. Her senior mentor was Claire Harris QC.
