Young’s List barrister Justin Castelan recently secured a significant victory for his client in what The Courier-Mail has called a landmark defamation stoush over a product review.
His client, a YouTuber who reviews lithium batteries, was sued for defamation in Queensland by the plaintiff after posting an unfavourable review. However, following a preliminary hearing, the court ruled that the plaintiff was not an excluded corporation and therefore not entitled to sue, leading to the case being dismissed.
This outcome reinforces the rights of online reviewers to provide honest opinions without fear of legal repercussions. A fantastic result by Justin, ensuring that fair critique remains protected.
