Bart Carew is a highly effective litigator and advocate with wide ranging experience covering the broad spectrum of commercial law. Bart is particularly experienced in banking and finance, insolvency, property law and the area of wills and probate. Bart provides both drafting and advocacy services, appearing regularly in the superior courts.

Banking and Finance; Bart’s practice includes all aspects of the bank-customer relationship, including both enforcing and setting-aside different types of personal and corporate loan agreements, mortgages, guarantees and other related securities. Bart also acts in litigation in respect of payment instruments, constructive trusts, tracing of assets, priority disputes in respect of securities and consumer credit.

Insolvency; Bart is experienced in acting for creditors (secured and unsecured), debtors, officeholders, liquidators, administrators and receivers in respect of insolvency related matters. His thorough knowledge of insolvency law provides clients with valuable insights in other commercial contexts. That knowledge is of great benefit in regard to property cases and banking cases, for example, as well as in formulating successful strategies for handling broader commercial disputes.

Wills & Probate; Bart is familiar with all aspects of probate. His litigation experience includes cases of testamentary incapacity (including issues of medical and psychiatric evidence) and he has also dealt with issues of forgery, undue influence and want of knowledge and approval. Bart is well versed in advising personal representatives in regard to the numerous problems encountered in the administration of an estate — will construction, correctly identifying beneficiaries, the defence of claims for testator’s family maintenance, partnership liabilities and countless others.
