Elizabeth
Bateman

Elizabeth practices in a broad range of commercial law matters, with a focus on arbitration, building and construction, insurance, property and insolvency law. Elizabeth has particular strength in advising clients on complex legal issues and litigation strategy.

Before coming to the Bar, Elizabeth was a Senior Associate at Norton Rose Fulbright. As a Senior Associate, Elizabeth gained extensive experience in international and domestic arbitration and advising clients on major projects including onshore and offshore oil and gas installations, public private partnerships and wind farms.

Elizabeth’s recent cases include: 

  • Metropolitan Fire & Emergency Services Board v Yarra Council (Supreme Court of Victoria): acting for the MFESB in respect of claims under the Environment Protection Act 1970 for the clean-up of abandoned pollution (with Fiona McLeod SC and Lindy Barrett).
  • Metropolitan Fire & Emergency Services Board v Architectus Group Pty Ltd & Ors (Supreme Court of Victoria): acting for a subcontractor in respect of claims for construction and engineering defects and the demolition and rebuild of the Glen Iris fire station.
  • Carrafa & Lofthouse (as trustees of the bankrupt estate of Santucci & Santucci) v Tile Mart (Vic) Pty Ltd [2018] FCCA 2164: acting for trustees seeking declarations that pre-bankruptcy transactions were void as against the trustees.
  • Owners Corporation PS646781P and Verve Constructions Pty Ltd & Ors (VCAT): acting for a respondent in a multi-party dispute concerning water ingress and alleged defective cladding at a residential apartment.
  • Priest Consulting Pty Ltd (receivers app’d) v Wallace & Ors (Supreme Court of Victoria): acting for the defendants in a complex dispute relating to the enforcement of a deed of charge, involving issues of misleading or deceptive conduct and estoppel (with Nicholas Pane QC, resolved prior to trial)
  • Green & Taylor v QBE Insurance (Australia) Pty Ltd (VCAT): acting for the insured in respect of a claim under policy of insurance, involving issues of election, demolition and rebuild (with Tim Margetts QC, resolved prior to hearing).
  • Bardan v Kahla & Ors (County Court of Victoria): acting for defendant in a dispute concerning claims for restitution and unconscionable dealing (resolved prior to trial).

Elizabeth was awarded the university prize for Jessup Moot, holds a Bachelor of Laws and Bachelor of Biomedical Science with first class honours, and is currently undertaking a Master of Laws at the University of Melbourne, focussing on construction law.

Elizabeth read with Andrew Woods and her senior mentor is Jeffery Gleeson QC.
