Elizabeth practices in a broad range of commercial law matters, with a focus on arbitration, construction, general commercial and insurance law. Elizabeth regularly advises clients on complex legal issues and litigation strategy.

Building and construction

  • Acting for an international consortium in relation to a complex and high-value international arbitration (ICC, Singapore) concerning the construction of a combine cycle power plant as part of an LNG project (with Jeffery Gleeson QC, Tim Margetts QC , David Bennett and Premala Thiagarajan).
  • Acting for a first-tier contractor in relation to a domestic arbitration (Resolution Institute, Melbourne) concerning the construction of Victorian infrastructure project (with Tim Margetts QC).
  • RW Health Partnership Pty Ltd v Lendlease Building Contractors Pty Ltd (VSC) – acting for a contractor in a multi-party proceeding concerning alleged defective works. See, RW Health Partnership Pty Ltd v Lendlease Building Contractors Pty Ltd [2019] VSC 353 concerning the successful opposition of an application for a stay under s 8 of the Commercial Arbitration Act 2011 (Vic) (with Jeffery Gleeson QC).
  • Acting for a multinational corporation on disputes concerning the delivery of several windfarms in Australia, involving issues of transportation, grid connection, general delay and damage (with Michael Christie QC).
  • Owners Corporation PS646781P and Verve Constructions Pty Ltd & Ors (VCAT) [2019] VCAT 642 – acting for a respondent in a multi-party dispute concerning alleged defective cladding at a residential apartment.
  • Khani-E v Simonds Homes [2019] VCAT 1446 – successful application for strike out and summary dismissal under s 75 of the VCAT Act.

General commercial

  • CSR Building Products Limited v Dematic Pty Limited and anor (VSC) – acting for a purchaser of a business concerning breach of warranty and alleged defective automated guided vehicles (with Christian Juebner).
  • Dynamic Industries Pty Ltd & Ors v Van Rooy & Ors; In the matter of Dynamic Industries Pty Ltd (VSC) – acting for a director in a derivative action for breach of fiduciary duties and other equitable remedies, and proceedings by liquidators for oral examination.
  • Sully v Englisch [2020] VCAT 378 – acting for a real estate agent in respect of a claim under s 18 of the Australian Consumer Law and s 32 of the Sale of Land Act 1962 (on appeal).
  • Carrafa & Lofthouse (as trustees of the bankrupt estate of Santucci & Santucci) v Tile Mart (Vic) Pty Ltd [2018] FCCA 2164 – successful claim acting for trustees seeking declarations that pre-bankruptcy transactions were void as against the trustees.
  • Priest Consulting Pty Ltd (receivers app’d) v Wallace & Ors (VSC) - acting for the defendants in a complex dispute relating to the enforcement of a deed of charge, involving issues of misleading or deceptive conduct and estoppel (with Nicholas Pane QC, resolved prior to trial).

Elizabeth is a recommended construction and infrastructure junior barrister in Doyle's Guide 2020 and reporter for the Building and Construction Law Journal.  Elizabeth was awarded the university prize for Jessup Moot, holds a Bachelor of Laws and Bachelor of Biomedical Science with first class honours, and is currently undertaking a Master of Laws at the University of Melbourne. Elizabeth also appears at the AFL and AFWL Tribunal for Carlton FC.  

Before coming to the Bar, Elizabeth was a Senior Associate at Norton Rose Fulbright. As a Senior Associate, Elizabeth gained extensive experience in international and domestic arbitration and advising clients on major projects including onshore and offshore oil and gas installations, public private partnerships and wind farms.

Elizabeth read with Andrew Woods and her senior mentor is Jeffery Gleeson QC.
