Ben is an experienced litigator who practices principally in the areas of commercial litigation and public law.  He accepts briefs in diverse areas of law and has appeared in a wide variety of courts including the High Court, Federal Court and state Supreme Courts, including at appellate level.

Prior to coming to the bar, Ben was a Senior Associate in the Commercial Litigation Department at Clayton Utz where he worked in both the Sydney and Melbourne offices.


Ben has been instructed to act for insurers and insureds across a broad spectrum of matters.  He currently holds briefs to appear in the Federal Court, County Court and Magistrates’ Court of Victoria.  Ben has particular expertise in relation to third party indemnities, builders warranty insurance claims, and business interruption claims.

Bankruptcy and insolvency

Ben has appeared in the Federal Circuit Court, Federal Court, Supreme Court and Courts of Appeal in both Victoria and South Australia in the bankruptcy and insolvency jurisdiction. He has assisted clients to both enforce and resist statutory demands and creditors petitions, and regularly advises corporate entities in relation to the external administration process.

General commercial

Ben acts in commercial matters ranging from breach of contract to consumer law, property and construction disputes, and banking and finance matters.  Among other things, he is presently briefed in the Great Southern recovery proceedings before Croft J in the Supreme Court, and recently conducted a trial in defence of claims alleging misleading and deceptive conduct.

Public and regulatory

Ben is a member of the Attorney-General’s approved list of preferred counsel, and is regularly briefed by Commonwealth departments to appear in the federal courts in administrative law matters.  He has also acted for and against the ACCC in competition cases. Ben has particular expertise in judicial review proceedings, having appeared unled at appellate level, including in the High Court.

Ben holds the degrees of LLM (University College London), LLB (Hons), and BA/BSc (Deakin).  While studying Ben was the recipient of a number of scholarships and academic awards.

He is also a member of Thomson Reuters’ stable of authors, having published works in both hard copy and online formats.
