The rule in Browne v Dunn is an important obligation of barristers in running trials. Yet the full content of the obligation is not always clear or fully understood. It can give rise to dispute in trials and in appeals. The session explained both the history of the rule and its modern application in civil cases and provided a practical guide for barristers as to the requirements of the rule and how to prepare cross examination in civil trials to ensure that it is complied with.
