Young’s List barrister Ben Petrie has secured a significant win in the Supreme Court of Victoria.
In The Export-Import Bank of China v CSTT Co Holdings Pte Ltd [2025] VSC 475 (Delany J), the Court rejected the plaintiff’s attempt to rely on an alleged security agreement said to support a US$74.5m facility made years earlier, confirming that past consideration is not good consideration. The Court also canvassed the indoor management rule and ratification, finding neither assisted on the facts; CSTT was not a party to the facility, implication and estoppel arguments failed, and the proceeding was dismissed.
A complex, technical matter — and a well-deserved result for the defence team. Ben Petrie acted for the successful defendant, instructed by K&L Gates.
