Samantha Cipriano has a broad commercial practice, with particular expertise in banking and finance, bankruptcy and insolvency disputes and the area of wills and probate. With over twenty years’ experience at the Bar, she is regularly briefed to appear in the superior courts both with a leader, and as sole counsel.
Samantha is also a Nationally Accredited Mediator and a member of the Victorian Bar’s Alternative Dispute Resolution Committee, she specialises in working with parties to resolve disputes in commercial, banking & finance and probate matters.
Samantha advises a range of banks and other financial institutions on large and complex financial disputes including, derivatives and structured product cases, contractual disputes, lender enforcement action, fraud and asset tracing (including proceeds of crime), insolvency related disputes and regulatory enforcement. Samantha has particular expertise in the enforcement of, and challenge to, security.
She has broad experience in acting for corporate and institutional clients in a variety of litigious matters including, corporations law matters, corporate insolvency, bankruptcy and directors’ disputes. Samantha is recognised as one of Australia’s leading junior barristers in insolvency law and litigation. She has been ranked in Best Lawyers Australia since 2016 in Insolvency and Reorganisation law.
Samantha is also familiar with all aspects of probate. Samantha accepts briefs to advise personal representatives in regard to the numerous problems encountered in the administration of an estate – will construction, correctly identifying beneficiaries, the defence of claims for testator’s family maintenance, partnership liabilities and countless others. She also accepts briefs in Guardianship and Power of Attorney matters at VCAT.
Prior to coming to the Bar, Samantha practiced as a solicitor with Freehills in Commercial Litigation. As a solicitor she conducted litigation in the areas of banking, insolvency, bankruptcy, corporations and security and contractual disputes. Samantha completed her articles at the Commonwealth Bank Legal Department, articled to Ian F. Purbrick.
Samantha is the Chair of the Banking and Finance section of the Commercial Bar Association.
