Oliver practises in all areas of commercial and public law.
Before coming to the Bar, he practised as a solicitor at Allens in its disputes team for five years and was Associate to the Honourable Justice John Middleton AM at the Federal Court of Australia and the Australian Competition Tribunal. He has also recently co-authored a book chapter with Justice Middleton concerning evidence in the Australian Competition Tribunal.
Oliver has particular experience in contractual and trust disputes, class actions, insolvency, regulatory investigations and commissions of inquiry (including royal commissions, ASIC and Anti-Dumping Commission investigations), judicial review and statutory interpretation advice.
Since coming to the Bar, Oliver has advised and appeared (led and unled) in a broad spectrum of commercial law matters, including:
- enforcement of foreign judgments in Australia (including Chinese);
- large discretionary family trust disputes;
- contract and ACL claims in the context of goods and services and franchise disputes, and business sale agreements, including in connection with technology, engineering and construction;
- loan, debt and other financial disputes;
- corporate insolvency and personal bankruptcy (e.g. [2024] FCA 1040);
- property disputes under the Sale of Land Act and Retail Leases Act;
- tax, including stamp duty and director penalty notices;
- employment, restraint of trade and confidentiality;
- intellectual property, including trade mark/passing off disputes; and
- ASIC investigations.
Oliver’s most recent commercial proceedings include:
- Trustee of B F McLaren Family Trust v Bowen Lane Developments Pty Ltd (Supreme Court of Victoria, led by M Rush KC and T Dowling) – judicial advice
- Shape Homes Pty Ltd v Lefoe (Supreme Court of Victoria, led by M Borsky KC) – contract
- Talacko v Bennett (Supreme Court of Victoria, led by K Loxley) – contract and estoppel
- Wang v Duan (Supreme Court of Victoria, led by J McKay) – enforcement of Chinese judgment
- House v Manos (Supreme Court of Victoria, unled) – enforcement of New York judgment
- Leon Cycle Pty Ltd v Hi5 Scooters Pty Ltd (County Court of Victoria, trial part heard, unled) – contract, Franchising Code of Conduct, unfair contract regime
- BDC Franchise Recruitment Partners Pty Ltd v Recovery Lab Franchising Pty Ltd (County Court of Victoria, unled) – breach of fiduciary duties, breach of non-compete and non-solicitation restraints
- ASIC v Merhi (Federal Court, unled) – asset preservation orders
Oliver has also advised or appeared in relation to various public, regulatory and administrative law matters, including:
- ASIC investigations;
- native title proceedings;
- migration judicial reviews (e.g. [2024] FedCFamC2G 1435, [2024] FedCFamC2G 1065); and
- statutory interpretation, including advice to government bodies in respect of regulatory powers.
